Terms of Service

These Terms of Service (“Terms”) govern your use of services from Sikand Marketing, operated by Prosimian Labs (“we,” “us”). By purchasing or using our services, you agree to these Terms.

What we provide

We design, build, host, and maintain a website for your business. The base tier includes:

• Custom website built to your business and industry.
• Hosting, SSL, and custom-domain management.
• One (1) content edit per calendar month included.
• Lead-form notifications delivered to your email.
• Basic visitor analytics (visits, click-to-call counts).
• Email support, 24–48 hour response on business days.

Pricing

$499 one-time setup + $79/month recurring. The recurring fee covers hosting, maintenance, and the included monthly edit. Additional edits are billed à la carte ($25–$150 depending on scope, quoted in advance). Founding-customer pricing (50% off setup with code FOUNDING50) applies to the first 10 customers.

30-day money-back guarantee

If, within 30 days of your initial purchase, you decide the Service isn't for you, email us and we'll refund the setup fee plus any monthly fees paid to date. After 30 days, the subscription is non-refundable but cancellable at any time (your subscription ends at the close of the current billing period).

Cancellation + ownership

You can cancel any time via your Stripe customer portal. On cancellation:

• Your site stays live for 60 days, then is decommissioned.
• We hand off your domain, content, and assets — you own the data.
• Lead-form submissions are exportable to CSV before decommissioning.
• The custom domain is detached from our infrastructure 30 days post-cancellation.

Acceptable use

You agree not to use the Service for:

• Illegal content or activities.
• Promoting hate, harassment, or violence.
• Adult content, gambling, or other restricted industries.
• Sending unsolicited bulk email (CAN-SPAM violations).
• Scraping, reverse engineering, or attempting to compromise our systems.

We may suspend or terminate accounts that violate this section, with refund of unused prepaid amounts.

Edits + content

You retain ownership of all content (text, photos, branding) you supply. You grant us a license to use that content solely to operate the Service. We retain ownership of the underlying templates, code, and design system, which are licensed to you for use on your site for the duration of your subscription.

Service-level expectations

We target 99.9%+ uptime, hosted on Vercel's edge network. We do not offer credits for downtime in this tier. If you need formal SLAs, ask about our enterprise tier.

Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption.

Disputes

These Terms are governed by the laws of the State of California. Disputes will be resolved in the state or federal courts located in California. You waive any objection to jurisdiction or venue.

Changes

We may update these Terms. Material changes affecting paying customers will be sent by email at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
